ABSTRACT

This chapter deals with the statutory provisions that apply to exemption clauses. The chapter will examine how the Unfair Contract Terms Act 1977 (UCTA) applies to some exemption clauses. We will see how UCTA distinguishes between exemption clauses rendered void and those needing to satisfy the ‘reasonableness test’. We will also see how the ‘reasonableness test’ is applied to contracts to which UCTA applies.
