ABSTRACT

The previous chapter examined the importance of agreement and the role an offer played in the formation of a contract. This chapter considers the acceptance element in the formation of a contract. We will see that an acceptance is the unconditional consent to the terms of the offer. Bearing in mind the unconditional consent element of an acceptance we will, perhaps oddly it may seem, start by examining the contrast between an offer and what is known as a counter offer. The reason for this is that we will see that a counter offer has the effect of destroying the original offer. This being the case there is no longer an original offer left to accept. This chapter will also examine the general rules that determine when an offer has been accepted. The chapter
