ABSTRACT

[23.01] Introduction. Under the contract of sale, it is normally envisaged that there will be a delivery of goods (see para 2.01 ) in exchange for the price (see para 2.06 ); and, leaving aside all questions of what must be delivered and what must be paid, 1 this chapter is concerned with the acts of delivery and payment. As s 27 of the SGA states:

‘It is the duty of the seller to deliver the goods, and of the buyer to accept and pay for them, in accordance with the terms of the contract of sale.’
