ABSTRACT
Whilst this section is subject to a contrary intention (s 55: set out at para 18.09), it plainly expresses the normal expectation of the parties to a contract of sale.2 By comparison, hp and simple hiring agreements are both forms of bailment (see para 1.17): the essence of the transaction is a transfer of possession for the payment of rent (see para 1.18).
