ABSTRACT
This type of action has proved very important for the development of Community law. It has been used by the European Court of Justice (ECJ) as a vehicle for establishing many of the fundamental principles covered in other chapters of this book. It is very important, therefore, to have a good understanding of this topic, which can arise in both problem and essay questions.
