ABSTRACT
An action for malicious falsehood may lie in common law for statements which damage the business reputation of another or his goods. The tort is also known as injurious falsehood or trade libel and is triable before a single judge and not before a judge and jury as in libel actions. Malicious falsehood usually has relevance where the plaintiff does not own a registered trademark.
