ABSTRACT

An easement is a right exercised over one plot of land (the servient tenement) for the benefit of another plot of land (the dominant tenement). We usually imagine an easement as a right of way or right to light, but there are many other rights that may be classified as easements, for example, a right to use a lavatory (Miller v Emcer Products [1956]) or a right to use neighbouring land as an airfield (Dowty Boulton Paul Ltd v Wolverhampton Corp (No 2) [1976]).
