ABSTRACT

Part I examines the evolution, jurisprudential and political challenges and the debate over the implementation of the RTD in the UN Working Groups. In order to gain a basic understanding of the RTD, it is necessary to discuss when, why and how the concept of the RTD emerged and what is its moral basis. An analysis of the voting patterns in the UN General Assembly and the Commission on Human Rights (Commission) will highlight the political positions of different groups of countries. As the book focuses on the legal status of the RTD, therefore an analysis of the jurisprudential controversies is important (Chapter 3). An examination of the current Working Group is required to explore the implications of the efforts to forge a consensus for international cooperation for the realization of the RTD (Chapter 4).
