ABSTRACT

Section 181 and Sched 5 provide for a right of appeal to the magistrates’ court against decisions of licensing authorities and the court has a number of options when determining an appeal. These include dismissing the appeal, making any decision that the licensing authority itself could have made in substitution for the decision reached by the authority, or remitting the case to the authority with a direction as to how it should be dealt with. The court may also make an order for the award of costs. Section 181 provides:
