ABSTRACT
Following the constitution of a trust, new trustees may be appointed by persons nominated in the trust instrument. In the absence of such a clause, the authority to appoint new trustees is specified in s 36(1) of the Trustee Act 1925. As a last resort, the court is entitled to appoint trustees under s 41 of the Trustee Act 1925.
