ABSTRACT

The regulation of working time derives from European law. There was a lot of fuss over the ‘Treaty base’ of the parent Directive – was it a ‘social provision’ or a ‘health and safety provision’? This all took time, and the provisions of Council Directive 93/104 EC ‘concerning certain aspects of the organisation of working time’ were brought into effect in the United Kingdom by the Working Time Regulations 1998 (SI 1998/1833), some two years later than in the other countries in the European Union.
