The document referred to in engineering contracts as “Conditions of Contract” is intended to regulate the relationships between the parties to the contract; it defines the parties and their responsibilities to each other as well as their responsibilities for various aspects of the contract. The liabilities of each of the parties and the respective risks to be taken by them are usually implicit in the defined responsibilities, but because of the complexity of the usual form of Conditions of Contract, it is preferable for those liabilities to be explicitly defined.
