ABSTRACT

Previous chapters have dealt with the drafting of Conditions of Contract, Specifications and Payment documents. These form the main bulk of the documentation in engineering contracts, but the contract also requires an offer or tender from the Contractor and an acceptance by the Employer, these being often confirmed by a formal contract Agreement. In addition, many contracts require the provision of a Performance Bond and there may be requirements for on-demand bonds against advance payments and for retention, as well as guarantees by corporate groups where the contract involves a subsidiary or a consortium of subsidiaries of group members.
