ABSTRACT

This adversarial relationship has its basis in the competitive bidding process commonly used by North American construction owners. In this process competitive bids are publicly requested from contractors with the construction contract awarded to the lowest qualified bidder. This type of competitive bidding process tends to move the bidding results away from the Parieto optimal by turning the process into a negative or zero sum game in which the contractor can only improve his position at the expense of the owner or other bidders.
