ABSTRACT

For solicitors who advise on the telephone or who attend detainees at a police station a question may arise as to whether an HIV-infected detainee should disclose their status to the police.

In some circumstances the decision may be taken away from the detainee-for example, if another person at the scene of the arrest discloses the fact to the arresting officers, or if the arrested person has medication on them from which HIV infection or disease can be inferred.
