ABSTRACT

Two alternative ways of dealing with the wearing of religious symbols, rather than simply banning them, are examined in this chapter: a duty of reasonable accommodation and an equality duty, both in relation to religion. The conclusion is that similar tests to the tests for justification in the previous chapters are used to establish whether these duties have been breached. This chapter provides the reader with an overview of the two duties and allows the reader to make a comparison between the four different legal ways of challenging a ban on the wearing of religious symbols.
