ABSTRACT

This chapter aims to provide a critical analysis of the key U.S. jurisprudence related to manifestations of the far-right in the form of hate speech and hate crime uttered and committed predominantly by Klu Klux Klan (KKK) followers. The purpose of this chapter is to put forth a starkly contrasting approach to hate in comparison to the approaches adopted on an EU, CoE and UN level, which, at varying levels, restrict manifestations of the far-right. Therefore, by putting forth a comparator, this chapter will subsequently facilitate further critical analysis of the way in which the far-right is treated under international and European law.
