ABSTRACT

What happens when a dispute board member needs to be removed either for ethical issues such as conflicts, or illness, or worse – how is this done is the subject of this chapter. Covering the various form contracts such as FIDIC the methods for replacement of dispute board members is discussed also covered are the rules of other appointing bodies such as the ICC and the DBF. Samples of forms and clauses to use for removal of dispute board members – both voluntarily and non-voluntarily are given along with procedures for appointing new dispute board members.
