ABSTRACT

This chapter deals with enforcing claims – is there a dispute? And when does a claim convert into a dispute that can be enforced by a dispute board. The most current case law on this subject is covered and the chapter also delves into when the ultimate decision given by the dispute board is enforceable and how – via arbitration. Dealing with the handling of interim dispute board decisions is also covered in detail with applicable case law provided and the current trends are discussed.
