Regulations within the healthcare field are increasing. Complying with regulatory agencies is a very important part of managing security in the healthcare arena. In order to comply with healthcare security regulations, it is important to understand the rules and regulations created by each regulatory agency and the meaning behind the regulations that they enforce. The enforcement of Centers for Medicare & Medicaid Services (CMS) regulations is conducted through the performance of on-site surveys. The focus of the survey is to determine whether a provider meets the requirements for participation in the Medicare and/or Medicaid program through evaluation of the CMS regulations. The CMS dictates the use of handcuffs or other restrictive devices on patients. CMS regulations state that law enforcement officials can use restrictive devices for custody, detention, and public safety reasons but not for any provisions related to the care of a patient. CMS states that patients have the right to be free from all forms of abuse or harassment.
