ABSTRACT

This chapter introduces students to behaviors that are consensually performed, and currently are or have been illegal for a variety of reasons. It explores students to think about behavior from a moral perspective, while at the same time allow for a variety of perspectives on the very same behavior. Once called "victimless" crimes, these behaviors are criminal only insofar as they offend the public moral order as defined by the dominant ideologies of right and wrong. Sexuality is valued differently depending on who is acting and how it is enacted. For instance, reproductive heterosexual monogamy is considered the "norm" whereas homosexual activity is largely viewed by popular opinion as "deviant," and promiscuity is considered immoral. Pornography involves the representation of sexual activity, with little or no artistic merit, for commercial trade and profit. The criminal justice system has failed miserably in its attempt to curb drug use and prosecute drug users and drug sellers.
