The Idaho Department of Motor Vehicles has yet to recognize the provisions of tribal courts. The misapprehension is more simple than a cultural bias, according to Kimron R. Torgerson. Fred W. Gabourie Sr., chief judge for the Kootenai Tribe and prosecutor of the Coeur d'Alene Tribe, says state and local authorities sometimes have a hard time understanding tribal ways of solving problems. The initial decision drew a loud outcry from politicians and the public, but tribal representatives say the episode is a tragic example of how state and local authorities ignore Indian jurisdiction. The push toward more self-governance, including a tribal police force and an experienced court, has a lot to do with gaining that respect, Kane believes.
