ABSTRACT

This chapter discusses trends in law and policy relevant to social and environmental issues in foreign direct investment. It first briefly reviews key concepts and instruments concerning corporate social responsibility, sustainable development, and human rights. It then examines experience in three illustrative policy areas: impact assessments, land rights, and labour rights. For each the analysis outlines key features of international law and guidance, main trends in national law, and practical experience to implement national and international law. A brief conclusion develops cross-cutting remarks. The overall discussion identifies key levers in law, policy, and practice and highlights their diversity and interconnectedness – from national law reform to international hard and soft law instruments, transnational avenues for recourse, and practical approaches for advancing implementation at the local level.
