ABSTRACT

The testator or testatrix should not have a mental illness or disorder that infl uences him or her to make bequests in the will that he or she would not otherwise have included. These criteria for defi ning and assessing testamentary capacity are based on the judgment in the case of Banks v Goodfellow.1
