Individuals who have experienced traumatic brain injuries are often involved in litigation to obtain nancial recoveries for the injuries they have experienced. Personal injury attorneys who work in this area typically do a wonderful job in the traditional aspects of litigation and settlement of the legal case. However, they are often completely unfamiliar with the long-term consequences of obtaining funds on behalf of the disabled client without proper planning for the long-term use and management of the funds. The same lack of awareness of the impact that resources generated from a personal injury claim held by a disabled person will have on that individual’s public bene t eligibility will also make a well-intended gift or contribution from a third party have disastrous consequences for the disabled individual.
