Habit-forming drug Narcotic or hypnotic drug listed in the Federal Food, Drug, and Cosmetic Act and chemical derivatives of them. 21 Code of Federal Regulations Part 329 contains a list of habit-forming drugs. Formerly, such drugs had to bear the label statement "Warning-May be habit forming." That labeling requirement was deleted by the Food and Drug Administration Modernization Act of 1997.
