Generally, ownership of navigable waters, in their natural state, is vested in the public or the state in trust for the public.* Water in its natural state is often treated as real property† but can be considered personal property when captured.‡ Real property refers to land, where as personal property includes nearly all that is not intimately connected or secured to the land.
