ABSTRACT

Legislative authority to collect deoxyribonucleic acid (DNA) samples and store DNA test results in a state DNA database should be clearly linked to recognized state interests. Recognizing the need for more uniform state laws to facilitate cooperation among states wishing to participate in the national system, the Federal Bureau of Investigation (FBI) has developed legislative guidelines for use in drafting or reviewing state DNA database laws. The guidelines are heavily influenced by provisions of the proposed “DNA Identification Act of 1991,” authored by Congressman Don Edwards. The agency or organization within state government responsible for the policy management and administration of the state-level DNA identification record system to support law enforcement, and for liaison with the FBI regarding the state’s participation in Combined DNA Index System (CODIS). State law should contain provisions that ensure conformance with the proposed “DNA Identification Act of 1991” governing participation by states in CODIS.
