ABSTRACT

Under Chinese law, foreign enterprises enjoy the legal freedom to hire staff for their enterprises as they see fit, choosing staff on the open market or selecting those available from their Chinese partner. In the case where they have just established representative offices, however, they must hire staff through a government service company, a requirement that some nevertheless manage to circumvent.
