Institutional racism may take the form of failure to recognize racial differences or a ‘feeling that these differences are not significant or that attention to individualized care will transcend them’ (Papadopoulos et al., 2004). However the Race Relations (Amendment) Act (2000) (Commission for Racial Equality, 2000) places a duty on all public authorities to tackle racism in service delivery. The Act stresses that employers can be held vicariously liable if their organization is found to be at fault and there is a positive duty on employers to take a proactive approach to racial equality.
