ABSTRACT
Under our constitutional system of law, the values of fairness and liberty place the burden on the prosecution in a criminal trial to present sufficient evidence to support a reasonable finding of guilt. A defendant does not have to present evidence to counteract the prosecution’s evidence but may do so.
