In February 2010, the court ruled the firm could represent accused gang members. However, Judge Freedman denied the defense motion to have the state appoint attorneys to the defendants, saying there is no existing case or law that gives him the authority to make such an order. One of the chief complaints made by injunction opponents has been that the lawsuit can result in jail time, but doesn’t offer the same protection of a court-ordered attorney that a criminal case would offer.
