ABSTRACT
There is, however, a difference in the case of a patient detained under the Mental Health Act 1983, when they may not, because of their symptoms, accept the need for medication and therefore not consent to receive it. Many detained patients are, nevertheless, capable of consenting to take medication, but some are incapable of doing so.
