ABSTRACT

The plaintiff, in City of Canton v. Harris (supra), brought a Section 1983 suit against the city, claiming that they violated her constitutional right to due process. Evidence presented during the trial showed that shift commanders in the police department were authorized to determine, at their discretion, whether a detainee required medical care and that the commanders were not provided with any special training to make such determinations. The district court decided in favor of the plaintiff on the medical claim, and the Sixth Circuit Court of Appeals affirmed that decision (Kappeler, 2006, pp. 65-66).
