ABSTRACT

Negligence involves more than merely demonstrating inadvertent behavior and injury or damage. There are four elements of negligence that must be shown for a liability claim: (l) a legal duty, (2) a breach of duty, (3) proximate cause, and (4) actual damage or injury (Battle v. County of Marin, No. C 01-04592 TEH (N.D. Cal. 2004); Estate v. Willis, 897 P.2d 78 (Alaska 1995); Ray v. Abington Township, No. 02-4382 (E.D. Penn. 2004)).
