Expert Witness Payment
The expert should send a written commemoration of fee requirements and any other specific billing or operations requirements the attorney may need before agreeing to retain the expert. The letter of retention is discoverable and offers some legal protection to ensure payment of all fees and expenses as stated. Attorneys must know that the expert expects prompt payment of fees, expenses, and other costs in an agreed-upon fashion. At times, attorneys will wait for an insurance payment or receivables (sometimes this can take months) before forwarding the forensic expert’s payment. This arrangement is fine provided that both the attorney and the expert agree.
