A forensic expert is “a witness who is qualified as an expert by knowl edge, skill experience, training, or education” pursuant to Rule 702 of the Federal Rules of Civil Procedure. Attorneys must also consider whether an expert is needed and, if so, how the expert will impact the judge and jury. Academic and/or practical experiences are covered later in this chapter when discussing fees, résumés (curriculum vitae), and federal rules that relate to the forensic expert. Attorneys usually consult with a proposed expert in order to determine opinions and then make an election to utilize the expert as a disclosed testifying expert.
