ABSTRACT

The requirement to negotiate any sort of a North American Subsidies Code was discarded in North American Free Trade Agreement and replaced by a weaker Working Group on Subsidies. If the Government of Canada is to ultimately succeed in developing a North American Subsidies Code or even a North American Competition Code, it needs to be recognized that, first it is going to be a tough political job, one which needs to be handled with delicacy but with force. To continue the successful implementation of the dispute settlement mechanism systems, and in order to iron out as many of the unanswered questions of their legal status as possible, there have to be regular consultations between the administrative agencies in Mexico, the United States, and Canada. One aspect of Canada-US relations that should continue to be of interest to Canadians is what, if any, are the changes to the US trade laws other than countervailing duties, anti-dumping or escape clause provisions.
