ABSTRACT

The law of contract in England and Wales is a ‘common law’ subject. A slightly different divergence can also be observed as having an impact on the development of the law – that is, the difference between a consumer contract and a contract between businesses. In other words, instead of looking at decisions of the appellate courts and the rules that they have developed, the focus could be on how contract law operates in people’s day-to-day lives. The common law of contract has tended to be insular in its outlook, though it has had a very significant international impact. The influence of the EU on contract law in England and Wales can be seen most clearly in the directives that have required implementation in the UK. The work of the Lando Commission was absorbed into a European Union project aimed at producing a draft of a European Contract Law.
