ABSTRACT

Chapter 7 provides a final perspective on the lessons the construction industry contract cases teach. First, it offers a retrospective assessment of the role the cases have played in the development of U.S. contract law. Next it explores how the construction industry experience may influence future developments in contract law. Finally, it argues for further construction law scholarship as this especially important segment of commerce moves toward more collaborative and complex exchange transactions that will increasingly impact matters of public policy, such as sustainable development, public safety, and general economic welfare.
