The Introduction outlines the critical challenge that this book aims to address, namely the failure of the international community and the international legal framework to ensure a dignified, rights-based existence to refugees in protracted situations. In response to these challenges, I identify the two primary contributions that this book seeks to make: to propose a new conceptual framework based on the capabilities approach and the fiduciary theory of state legal authority; and to make the argument that, based on this theoretical approach, legal empowerment has a critical role to play in the development of rights and dignity-respecting responses to refugee situations.
