ABSTRACT

This chapter explains the reasons for an extension of time clause and some of the basic principles. The JCT forms set out in some detail the procedure for the contractor in relation to delay and extension of time, and it is important for both contractor and architect to follow the procedure closely. If the contractor is in delay and seeks an extension of time they must also decide whether to accelerate the works at their own cost, either before or after the period allowed to the architect to decide on an extension. If the contractor does so, and the architect subsequently grants an extension, there is no mechanism in the JCT forms to compensate the contractor for the acceleration. MP2005 is the only one of the JCT forms that deals with acceleration. The employer can invite proposals from the contractor to achieve practical completion before the completion date, whether the contractor is in delay or not.
