ABSTRACT

This chapter highlights Kevin Boyle’s contribution to the field of Law and Religion even though he is traditionally seen as pertaining to the field of International Human Rights Law. It aims to develop some of Professor Kevin Boyle’s arguments in light of developments in order to demonstrate the timeless nature of the work. The chosen piece is of particular significance to the field of Law and Religion; it identifies the struggle for religious liberty as being at the core of the international human rights machinery, thus demonstrating that religious freedom and non-discrimination more generally are the tenets of human rights. Boyle also highlights the intimate connection between freedom of expression and freedom of religion and advocates church and state separation as a pre-condition for religious freedom. Boyle spoke out against some UN members’ attempts to create an offence of defamation of religion.
