ABSTRACT

This chapter aims to provide the analysis of the scope of application of the unimodal conventions. This analysis will be made in two steps; the first being an interpretation of the scope of application articles that considers that the uniform laws are actually international treaties and as such subject to international law. The chapter deals with a discussion of the rules and theories of treaty interpretation. The purpose of the thesis is to analyse the relationship between multimodal contracts of carriage and unimodal regulations that is the applicability of unimodal conventions to carriage of goods under a multimodal contract of carriage. The conventions regulating the carrier’s liability are, albeit particular in their nature of uniform law, international treaties, and as subject to the rules of international law. International conventions, or treaties, are agreements entered into by sovereign states intended to regulate the relationship between those sovereign states.
