ABSTRACT

In recent years, various new tunnels have been built along the Italian railway system that, although operating in a common regulatory framework, have adopted different contractual approaches, that in some cases can be even alternative.

The purpose of the article is to: analyze the different solutions adopted in defining contractual provisions; identify the relevant consequences in terms of contract total amount, duration of the works and amount of claim issued by the Contractors; define possible solutions that can reduce the effects for the Client and outline some criteria to be adopted in future contracts.

In order to carry out the above-mentioned evaluation, four tunnel projects, excavated with conventional methods have, been identified and, for each one of them, have been considered some indicators of the contractual approach and have been detected the outcomes during the development of the works.
