ABSTRACT

Since the declaration of independence in August 17, 1945, Indonesia has several constitutions changes. Starting from The 1945 Constitution (UUD 1945), Constitution of The Republic of the United States of Indonesia in 1949 (KRIS 1949), Temporary Constitution in 1950 (UUDS 1950), then back to original 1945 Constitution in July 5, 1959.

Based on The 1945 Constitution, people’s sovereignty was carried out entirely by the People’s Consultative Assembly (MPR). As the highest state institution, the MPR sets out the Constitution and the State Policy Guidelines (GBHN). The GBHN provides the direction of national development to achieve the country’s goals based on the Constitution.

On August 10, 2002, the fourth amendment to The 1945 Constitution was ratified by the MPR. These amendment changed the structure and hierarchy of the state institutions in Indonesia. The sovereignty of the people, which was originally carried out entirely by the MPR, is now implemented according to the Constitution. The MPR is no longer as the highest state institution, even losing the authority to determine the GBHN. Then, the important question is: if there is no GBHN, how to determine the direction of national development?

To answer the research question, the researcher in this normative research will use theoretical and qualitative methods. This research is aimed at political observers and constitutional law experts. This study proves the importance of the vision, mission and programs offered by the candidates of president and vice president in the presidential election. If the candidates of president and vice president are elected and win the presidential election, then their vision, mission and program will determine the direction of national development. Since there were no GBHN, then the vision, mision and of the president will determine the direction of national development. The vision, mision and program should be implemented in the period of the elected president’s term of office.
