ABSTRACT

The Codice cons. consists of 146 Articles and is divided into six parts. Part I contains general provisions. Article 1 thereof states the aim of the code as securing a high level of consumer protection, to be achieved through harmonisation and restructuring. In Article 2 the essential rights of the consumer and the user are enumerated and in Article 3 central terms such as 'consumer or user', and 'consumer association' are defined. Part II (Articles 4-32) concerns consumer information duties and advertising and other commercial statements. Part III (84 Articles) carries the description 'rapporto di consumo' and contains mainly contract law rules. In Articles 102-135 of Part IV 'safety and quality' rules are laid down relating to 'product security', 'product liability' as well as 'warranties and associated guarantees in contracts for the sale of consumer goods'. Parts V (Articles 136-141) and VI (Articles 142-146) contain provisions on consumer associations and judicial and extra-judicial protection of consumer interests and final dispositions.
