ABSTRACT

Litigation plays an important role in the collection of disputed debts. Similar regulations for the debt collection sector should be enacted in Turkey and the provisions of any future European Union directive should also be adopted. Associations of debt collection agencies at national and international level attempt to bring a certain discipline to the sector. A single small claim cannot be economically collected by debt collectors. With any sector of the private economy, debt collection business requires regulation in order to prevent any abuse of enforcement methods against the debtor. This applies in particular to ‘one-shotters’ who default due to financial difficulties. Public regulation of debt collection in Germany is more comprehensive than in England. The German model should be considered by the legislators in England with a view to improving their own regulations. Due to the increasing cross-border activities of commercial debt collectors, EU-wide regulation of the business has become a necessity.
