ABSTRACT

A garnishee order involving the courts, in which they divert the payment of monetary debts owed to the judgment debtor to the judgment creditor, is an effective method of enforcement in England. The High Court will grant registration when it is of the opinion that it is ‘just and convenient’ to do so, and such a registration renders the foreign judgment enforceable in England. The most important enforceable judicial acts are judgments and court orders. An English judgment takes effect from the day of the provided date and this is normally the day on which it is pronounced. Service of an endorsed copy of the judgment is necessary in order to begin only certain kinds of enforcement proceedings, i.e. committal and sequestration. In addition to the statutory provisions, the enforcement of a foreign judgment for money is also possible in England under the general rules of Common Law.
