ABSTRACT

This chapter presents the two cases of capture to highlight the need for finding alternative ethical frameworks for both the rule-making process and the oversight of the aviation industry. One such alternative can be found in Kantian deontology, a concept that Mark Waymack addresses. Two aspects of Kantian ethics are important to consider: the concept of Persons, in which people are treated as being ends in themselves; and the idea that universal laws contain no exceptions. Regulatory capture coincides with the question of ethical responsibility, and to solve the problem, the US needs a regulatory system that includes a stronger sense of obligation toward the public. The Federal Aviation Administration (FAA) is responsible for several voluntary reporting programs. The chapter focuses on its Voluntary Disclosure Reporting Program (VDRP), which was established in 1990 and includes entities such as air carriers and repair stations.
